Big changes to North Carolina estate planning took effect in 2026. The new law now allows electronically stored wills to be treated the same as traditional paper wills during probate. This modernization helps protect your wishes—even if the original paper document is ever lost or destroyed.

New Laws in NC

Under the new rules, an attorney can scan and securely store an electronic version of your will with proper certification. If the original document cannot be located, the certified electronic copy may be submitted to the court instead. This added safeguard can help reduce stress, confusion, and potential disputes for your loved ones during probate.

The update modernizes the estate planning process and gives families greater peace of mind knowing their plans are protected. It’s also a great opportunity to review your current estate plan and make sure everything is up to date.
